DMCA Takedown Policy
Fimil, Inc. (“Fimil”) respects the intellectual-property rights of others and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”).
1. Submitting a takedown notice
If you believe that content hosted on or accessible through the Service infringes your copyright, send a written notice to our Designated Agent (Section 3) that includes:
- a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it (such as a URL);
- your contact information (name, address, telephone number, and email);
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. Counter-notification
If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Agent that includes:
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location at which it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Fimil may be found), and that you will accept service of process from the complainant.
Upon receipt of a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed an action seeking a court order.
